Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Curvature QA platform, website, and related services (the "Service") operated by MunsonDesign LLC dba Curvature ("Curvature", "we", "us", or "our").

By accessing or using the Service, you agree to be bound by these Terms.

If you do not agree to these Terms, you may not use the Service.

Eligibility

You must be at least 18 years old to use the Service. By using the Service, you represent that you have the authority to enter into these Terms on behalf of yourself or the organization you represent.

Accounts

To access certain features of the Service, you may be required to create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately if you believe your account has been compromised.

Use of the Service

Curvature provides tools designed to analyze, validate, and review digital advertising creative assets before publication.

You agree to use the Service only for lawful purposes and in accordance with these Terms.

You may not:

  • Use the Service to violate any law or regulation
  • Upload malicious code, viruses, or harmful files
  • Attempt to disrupt or interfere with the Service
  • Reverse engineer, copy, or attempt to extract the source code of the platform
  • Use the Service to process or distribute unlawful content

User Content

The Service may allow you to upload files, creative assets, or other content ("User Content") in order to analyze or validate advertising creatives.

You retain ownership of your User Content.

By uploading content to the Service, you grant Curvature a limited license to process, store, and analyze that content solely for the purpose of providing the Service.

You represent and warrant that:

  • You have the rights necessary to upload and use the content
  • The content does not violate any intellectual property rights or applicable laws

Curvature does not claim ownership of your uploaded content.

Service Availability

We may modify, suspend, or discontinue parts of the Service at any time without prior notice.

We strive to maintain reliable service but do not guarantee uninterrupted availability.

Beta Features

Some features of the Service may be provided as beta or experimental features. These features may change, contain errors, or be discontinued without notice.

Feedback

If you provide feedback, suggestions, or ideas about the Service, you grant Curvature the right to use that feedback without restriction or compensation.

Intellectual Property

The Service, including all software, design, branding, and content provided by Curvature, is protected by intellectual property laws.

You may not copy, modify, distribute, or create derivative works based on the Service without our written permission.

Third-Party Services

The Service may integrate with or rely on third-party services or infrastructure providers. Curvature is not responsible for the availability or practices of these third-party services.

Termination

We may suspend or terminate your access to the Service at any time if you violate these Terms or if we reasonably believe your use poses a risk to the Service or other users.

You may stop using the Service at any time.

Disclaimers

The Service is provided for informational and quality assurance purposes only. While Curvature QA is designed to help identify potential issues in advertising creatives, the Service does not guarantee the accuracy, completeness, or reliability of any analysis, detection, or validation results.

Users remain solely responsible for reviewing, approving, and ensuring the compliance and accuracy of their advertising materials before publication or distribution.

The Service is provided “as is” and “as available” without warranties of any kind, whether express or implied.

Limitation of Liability

To the maximum extent permitted by law, Curvature and its owners, employees, and affiliates shall not be liable for any claims, damages, losses, or expenses arising from or related to the use of the Service.

This includes, without limitation:

  • advertising errors or omissions
  • incorrect or incomplete QA results
  • rejected or non-compliant advertising creatives
  • campaign performance losses
  • lost revenue or business opportunities

In no event shall Curvature be liable for any indirect, incidental, consequential, special, or punitive damages.

Maximum Liability

To the maximum extent permitted by law, Curvature's total liability for any claim arising out of or relating to the Service shall not exceed one hundred dollars (USD $100).

If the user has not paid for the Service, Curvature shall have no monetary liability.

Indemnification

You agree to defend, indemnify, and hold harmless Curvature, MunsonDesign LLC, and its owners, employees, affiliates, and service providers from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising out of or related to:

  • your use of the Service
  • your violation of these Terms
  • any content or files you upload to the Service
  • any advertising creatives, marketing materials, or other content processed through the Service
  • any claim that your uploaded content infringes or violates the intellectual property, privacy, publicity, or other rights of any third party

You are solely responsible for ensuring that you have all necessary rights, licenses, and permissions to upload and use any content submitted to the Service.

Curvature reserves the right to assume exclusive defense and control of any matter subject to indemnification by you, in which case you agree to cooperate with our defense of such claims.

No Legal or Compliance Advice

The Service is designed to assist with quality assurance and technical review of advertising creatives. The Service does not provide legal, regulatory, or compliance advice.

Users are solely responsible for ensuring that their advertising materials comply with all applicable laws, regulations, advertising standards, and platform policies. Any analysis, feedback, or results generated by the Service are provided for informational purposes only and should not be relied upon as legal or compliance guidance.

Changes to These Terms

We may update these Terms from time to time. When changes are made, the updated Terms will be posted on this page and the “Last Updated” date will be revised.

Continued use of the Service after changes become effective constitutes acceptance of the updated Terms.

Governing Law

These Terms are governed by the laws of the State of California, without regard to conflict of law principles.
